To help strengthen our fitness to practise approach, we’ve reviewed our case resolution processes. As a result, we plan to introduce an adjudicator consensual disposal process for cases that have progressed to the final hearing stage.
We’ve now opened an 8-week public consultation on new guidance we’ve developed to support people with the new adjudicator consensual disposal process.
The proposed guidance introduces a new process that allows adjudicators and social workers, in suitable cases, to reach an agreed outcome without the need for a disputed final hearing. This approach enables cases to be resolved more quickly when both parties agree on the facts and appropriate sanctions.
The consultation specifically focuses on whether the guidance document is clear and accessible to all users, including social workers, employers, adjudicators, and members of the public. We want to ensure the language used is appropriate and easy to understand.
The guidance covers the complete process from initial application through to final decisions. It:
- explains eligibility requirements
- outlines procedural steps
- clarifies the roles and responsibilities of all parties involved
The document also addresses what happens if proposals are accepted or rejected by adjudicators.
We have launched this 8-week consultation to:
- seek feedback on the clarity and accessibility of the accompanying guidance
- better understand the impact it may have on groups with protected characteristics
Please note that we are not consulting on whether to introduce the process itself.
