Drafting conditions

This guidance outlines the wording that should be used when drafting conditions. It should be read alongside our glossary of terms and impairment and sanctions guidance.

The guidance is for (all of the following):

  • our case examiners
  • adjudicators
  • social workers
  • Social Work England staff

Decision makers should use the conditions for both interim and final orders of conditions of practice.

The notes below state when a condition can be used for interim orders and whether they can be compiled with if the social worker is living abroad. Social workers are responsible for any costs associated with fulfilling conditions unless specified otherwise.

Social Work England may pay for some costs associated with fulfilling health conditions, such as the requirement for blood or other tests. This will be at our discretion.

Any reference to “days” in the bank is taken to be calendar days, not working days.

The wording of conditions have been carefully created to ensure all conditions are:

  • specific
  • measurable
  • achievable
  • relevant
  • timebound

Caution should be taken when (doing either of the following):

  • drafting bespoke conditions that are not included within the conditions bank
  • amending conditions within the bank

Guidance can be sought from the case review team on request.

Which conditions are private?

Most conditions are not private or confidential. We will publish them on the online register and disclose them to anyone who asks for them. These are marked as ‘not private’ in the notes below.

This makes sure the public are aware of any restrictions on a social workers practice and helps to maintain public protection.

There are some conditions that must be kept private and confidential, for example those that relate to the social worker’s health. These conditions are marked ‘private’ in the notes below. We do not publish these conditions on the online register.

We will need to share private conditions with certain parties. This will be in relation to specific conditions where those parties are involved with helping the social worker to show they are compliant with the conditions. Parties could include (any of the following):

  • workplace supervisors
  • reporters
  • current or prospective employers
  • general medical practitioners (GPs) and other medical professionals

An example of this might be where the social worker must stay under the care of a registered GP. The GP would need to know what to monitor and report on, but the wider public would not need to know.

Conditions framework

Social Work England's position is that applying a framework of conditions and including conditions 1 to 9 in all conditions of practice orders (interim or final) imposed upon a social worker's registration is essential. Conditions 1 to 9 set out the basic mechanisms Social Work England needs to effectively monitor compliance with the conditions of practice order to protect the public. 

For example, the conditions enable Social Work England to know:

  • where the social worker is working (conditions 1 and 7)
  • share and gather information around compliance (condition 2)
  • impose a reporter (and therefore have at least one other registered social worker that provides independent information to Social Work England) (conditions 3 and 4)
  • know of the presences of any new disciplinary concerns or investigations (conditions 5 and 6)
  • know of any new registrations with regulators inside and outside the UK (condition 8)
  • ensure that current or future social work employers are aware of the conditions (condition 9)

Conditions 1 to 9 ensure that Social Work England can monitor conditions of practice compliance, manage any risks and protect the public.

When the conditions drafter is applying the framework, they should consider that:

  • conditions 1 to 8 should always be the first conditions in the order
  • condition 9 should always be the final condition of the order and renumbered accordingly
  • any additional conditions should be placed between condition 8 and condition 9

When drafting conditions, decision makers can request the assistance of the case review team. The case review team can answer any questions decision makers may have around the conditions bank and how conditions can be formulated.

Condition 1

You must notify Social Work England at any time you are employed in a role, or providing social work services, which require you to be registered with Social Work England and provide the contact details of your employer, agency or any organisation with which you have a contract or arrangement to provide social work services, whether paid or voluntary.

The purpose of this condition is to allow us to keep track of the social worker’s employment status and make sure any employers are aware of their conditions.

Condition 2

You must allow Social Work England to exchange information with your employer, agency or any organisation with which you have a contract or arrangement to provide social work or social work educational services, and any reporter or workplace supervisor referred to in these conditions.

This can be tailored by removing roles such as reporter or workplace supervisor if you’ve chosen not to include these roles in the conditions.

Condition 3

a. At any time you are employed in a role, or providing social work services, which require you to be registered with Social Work England, you must agree to the appointment of a reporter nominated by [X] and approved by Social Work England. The reporter must be on Social Work England’s register (and can be the same person as the workplace supervisor).

b. You must not start or continue to work until these arrangements have been approved by Social Work England.

The reporter is normally nominated by the social worker. Reporters should be used in all cases. This is to ensure (as a minimum) that there is information about the social worker’s conduct, performance and compliance with the order. We can approve reporters in one business day if all required information is sent at the time of the request.

If the drafter does not include an additional condition requiring a workplace supervisor then the reference to them in this condition can be removed. 

Condition 4

You must provide reports from your reporter to Social Work England every [X] months and at least [X] days prior to any review and Social Work England will make these reports available to any workplace supervisor referred to in these conditions on request.

The frequency depends on the case.

In the case of an interim order, the requirement for a report ‘X days prior to any review’ can be removed due to the frequency of review hearings.

Condition 5

You must inform Social Work England within 7 days of receiving notice of any formal disciplinary proceedings taken against you from the date these conditions take effect.

You must inform Social Work England within 7 days of receiving notice of any investigations or complaints made against you from the date these conditions take effect.

Social workers who are self-employed are unlikely to put themselves through formal procedures. Therefore, this is a suitable additional condition to capture both employment and self-employment.

Condition 7

You must inform Social Work England if you apply for social work employment / self-employment (paid or voluntary) outside England within 7 days of the date of application.

Condition 8

You must inform Social Work England if you are registered or subsequently apply for registration with any other UK regulator, overseas regulator or relevant authority within 7 days of the date of application [for future registration] or 7 days from the date these conditions take effect [for existing registration].

This will allow us to notify any relevant UK, EU or non-EU regulators or relevant authorities. Do not remove the bracketed text.

Condition 9

You must provide a written copy of your conditions, within [X] days from the date these conditions take effect, to the following parties confirming that your registration is subject to the conditions listed at (X) to (X), above:

  • Any organisation or person employing or contracting with you to undertake social work services whether paid or voluntary.
  • Any locum, agency or out-of-hours service you are registered with or apply to be registered with in order to secure employment or contracts to undertake social work services whether paid or voluntary (at the time of application).
  • Any prospective employer who would be employing or contracting with you to undertake social work services whether paid or voluntary (at the time of application).
  • Any organisation, agency or employer where you are using your social work qualification/knowledge/skills in a non-qualified social work role, whether paid or voluntary (at time of application).

You must forward written evidence of your compliance with this condition to Social Work England within [X] days from the date these conditions take effect

This should always be the final condition. Consider whether any private conditions need to be excluded. The drafter must choose the appropriate timeframe. This must be a specific number of days, not just words like ‘promptly’. The deadline for evidence of compliance with the condition being sent to us should usually be longer than the deadline to inform. We recommend the social worker is given no longer than 7 days to inform the parties and no longer than 14 days to provide evidence of compliance of the same to Social Work England. This is in order to protect the public and ensure that the condition remains workable.  

 

Personal development plan

All social workers with concerns about their practice should have an active personal development plan. At least one of these conditions should normally be included.


Condition 10

You must work with your [workplace supervisor/reporter], to formulate a personal development plan, specifically designed to address the shortfalls in the following areas of your practice:

This is applicable in cases where the concerns raised are about the social worker’s practice. This is normally a final order condition as interim orders are not about remediation, however, there may be interim orders where this condition is necessary for the protection of service users. If this condition is used for an interim order, the drafter must include the word ‘alleged’ before ‘shortfalls.’  The drafter must list all the areas that require development relating to the facts of the case.

If using this condition, condition 12 must also be included.

Condition 11

a. At any time you are employed in a role, or providing social worker services, which require you to be registered with Social Work England, you must formulate a personal development plan, specifically designed to address the shortfalls in the following areas of your practice:

  • [List the areas requiring development]

b. Your personal development plan must be signed off by your employer.

Although it is expected as a minimum that a reporter is set as part of the framework conditions, this is a suitable alternative to condition 10 in cases where a workplace supervisor or reporter has not been set.

This is normally a final order condition as interim orders are not about remediation, however, there may be interim orders where this condition is necessary for the protection of service users. If this condition is used for an interim order, the drafter must include the word ‘alleged’ before ‘shortfalls.’

The drafter must list all the areas that require development relating to the facts of the case.

If using this condition, condition 12 must also be included. 

Condition 12

You must provide a copy of your personal development plan to Social Work England within [X] weeks from the date these conditions take effect and an updated copy [X] weeks prior to any review.

The drafter should only use this condition if they have included conditions 10 or 11. 

The drafter must specify the length of time to complete the condition and whether or not they want an updated copy before a review.

If an updated copy is required, we would suggest this is required at least 28 days prior to any review to ensure any issues within the personal development plan can be explored as part of preparation for the review hearing.

 

Workplace supervision


Condition 13

a. At any time you are employed, or providing social work services, which require you to be registered with Social Work England; you must place yourself and remain under the [close/direct/delete altogether where appropriate] supervision of a workplace supervisor nominated by [X], and approved by Social Work England. The workplace supervisor must be on Social Work England ’s register (and can be the same person as the reporter).

b. You must not start or continue to work until these arrangements have been approved by Social Work England.

Please refer to the glossary of terms for the definition of a workplace supervisor. The drafter will need to define the level of supervision the social worker will need, particularly if the level of supervision is different for different activities. The workplace supervisor may be the same person as the reporter if it’s appropriate. We can approve workplace supervisors in one business day if all required information is sent at the time of the request. 

If this condition is used, condition 14 must also be included. 

Condition 14

You must provide reports from your workplace supervisor to Social Work England every [X] months and at least [X] days prior to any review, and Social Work England will make these reports available to any reporter referred to in these conditions on request.

You must keep your professional commitments under review and limit your social work practice in accordance with your workplace supervisor’s advice.

Conditions for social workers with health issues


Condition 16

a. You must place yourself under medical supervision by a named medical supervisor approved by Social Work England, attend appointments as arranged, follow their advice, and comply with their recommended treatment.

b. You shall advise Social Work England of your medical supervisor nomination within [X] days of these conditions taking effect.

c. You must provide a copy of the full determination to your medical supervisor and provide written evidence of your compliance with this condition to Social Work England within [X] days of this condition taking effect.

d. You must provide reports from your medical supervisor to Social Work England every [X] months and at least [X] days prior to any review.

This must be directed for all final order conditions where the social worker’s fitness to practise is impaired through physical or mental health and there are multiple medical professionals involved in the social worker's care. If there are not multiple health professionals involved, conditions requiring GP reports and GP involvement only will suffice. 

Please refer to the glossary of terms and the guidance for supervisors and reporters for information about the role of the medical supervisor. The time frame for reporting must be decided by the drafter. The deadline for evidence of compliance with part c being sent to us, should usually be longer than the deadline to advise of their nomination at point b.

The drafter may also wish to consider adding additional sub-points to the condition requiring the social worker to share their reporter/workplace supervisor’s reports with their medical supervisor. For example:

“e. You must share your workplace supervisor/reporter reports with your medical supervisor within 7 days of the reports being sent to Social Work England."

"f. You must forward written evidence of your compliance with point e. to Social Work England within 7 days of this condition taking effect.”

This condition can still be complied with if the social worker is outside of England.

Condition 17

You must allow Social Work England to exchange information with your medical supervisor regarding your progress under any treatment, your fitness to practise and your compliance with these conditions.

Condition 18

a. Within [X] days from the date these conditions take effect, you must register with and remain under the care of a general medical practitioner (GP) and provide them with a written copy of the full determination, including these conditions.

b. Within [X] days from the date these conditions take effect, you must inform [your medical supervisor and] Social Work England of the name and contact details of your GP and any other registered medical practitioner responsible for your care, and to inform those practitioners about your impairing condition and any treatment which you are receiving.

c. You must allow [your medical supervisor and] Social Work England to exchange information about your health, (and any treatment you are receiving), with your GP and any other registered medical practitioner responsible for your care, including your occupational health practitioner(s).

d. You must inform Social Work England within 7 days of any change in your GP registration.

e. You must provide written evidence of your compliance with points a and b of this condition to Social Work England within [X] days of these conditions taking effect.

Use this condition together with condition 16 or instead of condition 16. If you’re not using condition 16, remove reference to the medical supervisor in this condition at point b and point c.

Point e should also be tailored if there is no medical supervisor to remove reference to providing evidence for point b. The drafter must choose the appropriate timeframe. This must be a specific number of days, not just words like ‘promptly’.

The drafter may also wish to consider adding additional sub-points to the condition requiring the social worker allow us to share their reporter/workplace supervisor’s reports with their GP. For example:

“f. You must share your workplace supervisor/reporter reports with your GP within 7 days of the reports being sent to Social Work England."

"g. You must forward written evidence of your compliance with point e. to Social Work England within 7 days of this condition taking effect.”

Condition 19

You must provide reports from your GP to Social Work England every[X] months and at least [X] days before any review hearing.

Condition 20

a. You must obtain the approval of your medical supervisor/GP/psychiatrist before accepting or continuing to work in any post for which registration with Social Work England is required.

b. You must forward written evidence of any approval to Social Work England prior to starting any post for which registration with Social Work England is required.

a. You must cease work immediately if your medical supervisor/GP/psychiatrist advises you to do so.

Condition 23

You shall not engage in independent social work practice and shall only work at premises where another registered social worker is working at the same time as you are working and with whom you have made personal contact with before you commence work each day.

This condition can be particularly useful for social workers with drug and alcohol issues. It allows other registered professionals to assess whether they appear to be under the influence before work duties start by having an open discussion with the social worker. The social worker should agree a protocol with those they are expected to work with, detailing how this will work in practice. The effect on social workers who are currently independent practitioners will be to stop them from working alone. This will be justified in the context of minimising risk to the public and would not prevent the social worker working in another setting.

Condition 24

You will permit other members of the social work team at your place of employment to contact your medical supervisor/GP and Social Work England immediately if they are concerned about your fitness to practise.

The social worker should agree a protocol with those that are allowed to make contact with either us or their medical professionals, detailing how this will work in practice. This will require a certain amount of confidential information to be shared with other members of the social work team.

 

Conditions for all social work professionals with alcohol and/or drug misuse problems

All social workers found or alleged to have impairment as a result of alcohol and/or drug misuse should have some or all of the following conditions attached to their registration.


Condition 25

You must comply with arrangements made by, or on behalf of, Social Work England for the announced or unannounced testing for the recent and long-term ingestion of [alcohol and/or drugs]. The cost of this testing will be paid for by Social Work England.

If drugs are involved, the drafter should specify which specific drugs they wants us to test for. For example, codeine and tramadol. The drafter should use this condition if they intend for Social Work England to pay for testing. This will often be the case for interim orders. The cost of remediation should be paid for by the social worker. We should only pay for testing if the social worker has adequately demonstrated they cannot pay.

We strongly recommend that decision makers request the assistance of the case review team for guidance on which testing would be most appropriate.

Condition 26

a. You must make arrangements for the testing of breath/blood/urine/saliva/hair/nails (amend as required) for the recent and long-term ingestion of [alcohol and/or drugs]. You will be responsible for the cost of this testing.

b. You must provide test results to Social Work England every [X] months and at least [X] days prior to any review.

The drafter should use this condition if they intend for the social worker to pay for their own testing. The drafter should try to assist the social worker by detailing which tests need to be done and at what frequency using the medical reports they have available. If drugs are involved, the drafter should specify which specific drugs they want testing. For example, codeine and tramadol.

We strongly recommend that decision makers request the assistance of the case review team for guidance on which testing would be most appropriate.

Condition 27

a. You must attend [monthly/bi-monthly] meetings of [Alcoholics Anonymous/Narcotics Anonymous/any other support group/individual alcohol/drug counselling], if recommended to do so by your medical supervisor/GP/psychiatrist.

b. You must provide written evidence of your attendance at such meetings to Social Work England every [X] months.

If it’s appropriate, the drafter can adapt part (a) to include the frequency of the social worker’s attendance at meetings. The drafter should define the appropriate medical professional and the appropriate meeting to be attended.

Personal alcohol use


Condition 28

a. You must abstain absolutely from the consumption of alcohol.

b. If you do drink, you must inform your medical supervisor/ GP psychiatrist and Social Work England within 24 hours and follow any advice that they may give you.

a. You must limit your alcohol consumption in accordance with your medical supervisor/ GP /psychiatrist’s advice, abstaining absolutely if required.

b. If you exceed your recommended alcohol consumption, you must inform your medical supervisor/ GP psychiatrist and Social Work England within 24 hours and follow any advice that they may give you.

Condition 30

You must abstain absolutely from the taking of [drugs].

You must not possess those drugs listed in Schedules 1-4 of the Misuse of Drugs Regulations 2001, (as may from time to time be amended) and only take drugs prescribed or administered for you (including over the counter drugs that do not require a prescription in England) by a prescribing practitioner responsible for your care.

Condition 35

a. You must not take drugs listed in Schedules 1-4 of the Misuse of Drugs Regulations 2001 (as may from time to time be amended) unless prescribed or administered for you by a prescribing practitioner responsible for your care.

b. You must inform Social Work England that you have been prescribed or administered a drug listed in the Schedules 1-4 Misuse of Drugs Regulations 2001, and the circumstances of this, within 7 days from the date of the prescription.

Treating psychiatrist


Condition 36

You must remain under the care of a treating psychiatrist and must allow your GP/medical supervisor and Social Work England to exchange information with them about your condition and the treatment you are receiving.

Practice restrictions (working arrangements)


Condition 37

You must only work as a social worker in premises where at least 2 other social workers are employed at any one time and are on the premises daily.

Condition 38

You must not supervise the work of any other social worker or student social worker.

This condition prevents practice educators, assessed and supported year in employment (ASYE) supervisors or those who manage other social workers from supervising the work of others. This is particularly relevant for social workers where there are competency issues with their practice or concerns about their workplace conduct.

You must not be responsible for the work of any other social worker or student social worker.

Condition 40

The drafter should be aware that for some Crown Dependencies or British Overseas Territories they do not have their own regulator. Misuse of Drugs Regulations 2001

Drugs controlled under the Misuse of Drugs Act 1971 are placed into five categories referred to in ‘schedules 1-5’ of the Misuse of Drugs Regulations 2001. The categorisation is based on their medicinal or therapeutic usefulness and the need for legitimate access and the potential harm they can cause when misused. The more harmful the drug could be if misused, the higher up the schedule and the stronger the controls around its availability.

Schedule 1

Drugs that have no therapeutic value and their production, possession and supply are limited to research or other special purposes.

Examples include cannabis and MDMA (ecstasy).

Schedule 2

Drugs that have therapeutic value but are highly addictive. These drugs are strictly controlled and subject to special requirements relating to their prescription, dispensing, recording and safe custody.

Examples include potent opioids such as morphine and diamorphine.

Schedule 3

Drugs which are less likely to be misused than the drugs in schedule 2 or are less harmful if misused. There will still be special requirements relating to their prescription and dispensing but they do not need to be kept in safe custody or be recorded in a controlled drugs register.

Examples include tramadol, temazepam, midazolam, buprenorphine and methylphenobarbitone.

Schedule 4

Part 1 covers benzodiazepines (for example diazepam (valium) but excluding temazepam and midazolam which are in Schedule 3).

Part 2 covers anabolic and androgenic steroids (for example prasterone, testosterone and nandrolone). These are subject to lighter regulation, being exempt from safe custody and prescription writing requirements.

Schedule 5

Weaker preparations of schedule 2 drugs that present little risk of misuse. These can be sold over the counter in pharmacies without prescription.

Examples include codeine, medicinal opium or morphine (less than 0.2% concentration).
